1. Refund Eligibility

All subscription plans are eligible for a refund within ten (10) days from the initial purchase date.

2. Refund Process

To request a refund, please contact our customer support at su*****@ev******.com. In your refund request, include your name, email address, and a description of the reason for your refund request.

Upon receiving your refund request, we will review it and determine if you meet the refund eligibility criteria. If your request is approved, we will process your refund within seven (7)  business days. Refunds will be issued using the same payment method that you used for the original purchase.

3. Non-Refundable Items

The following items are non-refundable:

  • Fees for any period of usage beyond the refund eligibility period.
  • Any service fees or third-party charges associated with the purchase.

Terms of Service (“ToS”) for The Evolytix Dashboard

1. Acceptance of Terms

By accessing or using The Evolytix Dashboard (“the Service”), you agree to comply with and be bound by these Terms of Service. If you do not agree with these terms, do not access, or use the Service.

2. Use of the Service

1.     You must be at least 18 years old to use the Service.

2.     You agree to use the Service only for lawful purposes and in accordance with these Terms.

3.     You are responsible for maintaining the security of your account and passwords. Notify us immediately of any unauthorized use of your account.

3. Payment and Subscription

1.     The Service is provided free-of-charge for a period of thirty days. After this free trial period:

                                                   I.         The Service is provided on an annual subscription basis. You agree to pay all applicable fees based on your chosen subscription plan.

2.     Fees are non-refundable except as expressly provided in our refund policy.

4. Intellectual Property

1.     The Service and its contents are the intellectual property of Evolytix and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service.

2.     You may not reproduce, distribute, modify, create derivative works, or reverse engineer the Service.

5. Privacy

1.     Your use of the Service is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information.

2.     By using the Service, you consent to the practices described in the Privacy Policy.

6. Termination

1.     We reserve the right to suspend or terminate your access to the Service for any reason, without notice.

2.     Upon termination, your account and data may be permanently deleted.

7. Limitation of Liability

1.     To the extent permitted by law, Evolytix LLC is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of the Service.

2.     We do not warrant that the Service will be error-free or uninterrupted.

8. Changes to Terms

We may update these Terms of Service from time to time. You will be notified of material changes. Continued use of the Service after changes signifies your acceptance of the updated terms.

9. Governing Law

These Terms are governed by the laws of New York State. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Westchester County, New York.
